Tribunal details must be made public

The names and addresses of organisations involved in employment tribunal cases must be made public, according to a new ruling under the Freedom of Information Act.

The Information Commissioner's Office has decided it is in the public interest for this information to be disclosed and has ordered the Department for Business, Enterprise and Regulatory Reform (BERR) to release it.

From 1965 until 2001 it was routine to publish this information, but following a government consultation, the decision was made to stop publishing the details.

The ICO asked BERR to provide evidence of any harm providing the details might cause. BERR responded by saying it would "prejudice the effective conduct of public affairs", leave organisations open to direct marketing, publicly expose disputes and damage employers' reputations.

Graham Smith, deputy information commissioner, concluded: "There is very weak - if any - public interest in making the exemption" and the public interest in maintaining the exemption does not outweigh the public interest in disclosing it.
